Algemene Voorwaarden

1. Definitions

In these terms and conditions, the following is understood to mean:

• Cycle EV Mobility: Cycle EV Mobility, established and having its registered office in Rijswijk.
• Buyer: The person who enters into or has entered into a purchase agreement with Cycle EV Mobility.

2. Applicability

These general terms and conditions apply to all offers from Cycle EV Mobility BV and to all agreements between Cycle EV Mobility BV and the buyer.

3. Offer, order, conclusion and cancellation of the agreement

• All quotations and offers from Cycle EV Mobility BV are entirely without obligation, unless otherwise agreed in writing.
• The validity period of a quotation is 3 months.
• The agreement between Cycle EV Mobility BV and the buyer is concluded by the signing of a written purchase agreement, or by electronic or written acceptance by Cycle EV Mobility BV of an electronically placed order.
• The buyer may cancel the purchase agreement as long as the sold item has not yet been delivered, in which case the buyer is obliged to indemnify Cycle EV Mobility BV with a fixed compensation of 30% of the purchase price (including VAT), unless the actual damage is higher.

4. Prices, rates and payment

• Sales and delivery shall be subject to the prices and rates of Cycle EV Mobility BV applicable at that time.
• Cycle EV Mobility is entitled to increase the purchase price in the event of price increases if delivery takes place more than three months after the purchase.
• Payment by the buyer shall be made upon delivery, unless otherwise agreed in writing. In the event of late payment, the buyer shall be in default without further notice of default.
• Collection costs are fixed at 15% of the invoice amount, unless the actual costs are higher.

5. Delivery

• Delivery takes place at the place and time agreed upon by the parties.
• The risk of loss or damage to the delivered goods passes to the buyer upon delivery.
• If the buyer is not present at the agreed time of delivery, additional delivery costs will be charged.
• Any defects that are not immediately visible must be reported in writing to Cycle EV Mobility BV within 3 days of discovery.

6. Force Majeure

In the event of force majeure, the obligations of Cycle EV Mobility BV shall be suspended for the duration of the force majeure situation. This includes, among other things, delays at manufacturers or importers.

7. Retention of Title

Cycle EV Mobility BV retains title to all delivered goods until the buyer has fully met all its payment obligations.

8. Warranties

• Cycle EV Mobility BV offers a 2-year warranty on the proper functioning of the vehicle, 2 years on the battery and painted body parts, and 2 years on the frame. This warranty applies to the motor and load-bearing parts.
• Exceptions to the warranty include wear and tear, improper use, and repairs performed by third parties without the permission of Cycle EV Mobility.
• The warranty becomes void if the maximum speed is increased.
• The warranty also becomes void if the vehicle is resold within the warranty period.
• For repairs under warranty, call-out charges within the Netherlands will be charged to the customer by the seller. A suitable quotation will be provided for the transport where the vehicle needs to be picked up. No additional costs will be charged for delivering the vehicle to the workshop.
• The service must be performed with a 10% margin every 2,000 km; otherwise, the warranty will be void.

9. Liability

Cycle EV Mobility BV is only liable for direct damage resulting from an attributable failure. Cycle EV Mobility BV is not liable for indirect damage, including lost profits, consequential damage, and business damage, unless there is intent or willful recklessness. The liability of Cycle EV Mobility BV is limited to a maximum of the invoice amount of the relevant agreement.
